CHARTER ORDINANCE EXEMPTING THE CITY OF OBERLIN FROM THE PROVISIONS OF K.S.A 1988 Supp. 12-1222, AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OBERLIN:

SECTION 1. (EXEMPTION.)

In accordance with the authority granted to cities by K.S.A. 79-5036(s), as amended, and Section 5 of Article 12 of the Kansas Constitution, the City of Oberlin hereby elects to exempt itself from and to make inapplicable to the City of Oberlin the provisions as are set out in this ordinance. The provisions of the above mentioned statute apply to the City of Oberlin, but do not apply uniformly to all cities in Kansas, as per A.G.O. #89-133.

SECTION 2.

The governing body of the City of Oberlin is hereby authorized and empowered to exempt itself from the requirement that library board members be residents of the municipality. The governing body may appoint a maximum of two library board members from outside the borders of the municipality and within the county of Decatur, excluding the city of Oberlin.
