It shall be unlawful for any person to sell, offer for sale or fire any fireworks or pyrotechnics within the city, except from June 27 to July 5 of each year, inclusive.

It shall be unlawful for any person to discharge or set off any fireworks or pyrotechnics within the city limits between the hours of 12:00 midnight and 6:00 a.m. of any day on which it is otherwise lawful to fire or set off fireworks. It shall be unlawful for any person to discharge or set off any fireworks or pyrotechnics, within the following areas within the city limits at any time whatever, to wit: on Penn Avenue, between Maple Street on the north to Victoria Street on the south.

It shall be unlawful and a violation of this article for any person to violate any of the laws, rules and regulations of the state, made by the legislature thereof, or by the state’s Fire Marshal.

(a)   Fireworks may be discharged at any time pursuant to a city issued permit at the Decatur County Fair Grounds in a public display, as the same is defined by state law; provided that:

(1)   Consent for same has been given by the Board of Decatur County Commissioners;

(2)   The fireworks discharge is supervised and actually conducted by a person certified by the state’s Fire Marshal for public displays;

(3)   The certification from the state’s Fire Marshal is provided to the city on an application to be provided by the city at the time the application is filed;

(4)   The person applying for the public display certifies that they will comply with all appropriate state fireworks statutes and regulations; and

(5)   The person applying for the public display provides an insurance policy naming the city and county as additional insured and agrees to hold the city and county harmless from any and all liability associated with such public display.

(b)   The City Manager shall be responsible for the issuance of a permit for such public fireworks display. In determining whether or not to issue the permit, the City Manager shall consider weather conditions, fire considerations and any other matter deemed appropriate and such permit may be revoked in the event that circumstances so dictate. A fee of $50 per proposed calendar date of fireworks discharge shall be paid at the time of application which amount shall be non-refundable in any event.
