There hereby is created a board of health for the city. The Board shall consist of the City Manager, City Clerk and the Chief of Police of the city. The City Manager shall be the Chairperson of the Board, and the City Clerk shall be the Secretary of the Board. The Board may adopt such rules and regulations as may be deemed necessary to carry out the provisions of this article, ordinances of the city and the statutes of the state, in regard to health and vital statistics.

It shall be the duty of the Board of Health to prescribe rules and regulations to be approved by the City Council for carrying out the ordinances of the city and for carrying out the laws of the state, relating to public health and vital statistics, and it shall perform such duties and have such powers as are imposed upon it by the ordinances of the city, and the laws of the state.

Any person violating, refusing or neglecting to obey any of the rules and regulations or procedures made by the Board of Health of the city or by the state’s Board of Health for the prevention, suppression and control of a dangerous, contagious, infectious or communicable diseases, shall be guilty of a misdemeanor and, upon conviction thereof, shall be fined in an amount of not more than $500 for each offense, or to imprisonment not to exceed 30 days, or to both such fine and imprisonment. Upon failure to pay such fine, the violator shall be imprisoned in the city jail until same are paid.
